Terms Of Service


DISCLAIMER

• By purchasing my services (art), you automatically agree to the following conditions.• Please read my entire TOS before placing a commission. I will refuse your commission if you do not agree to these terms.• If you are not comfortable with my Terms Of Service and/or are not willing to agree to the conditions, you may not request a commission.• Do not use my art for NFTS and do not upload it to any AI "art" websites or use it in any other nefarious way. If you do this I shall blacklist you and you will not be able to commission me again. Ever.• Do not attempt to bargain with me/haggle for prices. This will also get you blacklisted (this ain't a boot sale... please don't do this).


General Information

You, the Client

• You will be expected to read my TOS and understand my general Commission Prices.• You may display my work online as long as it is visibly credited and linked back to me. (so if you post on Twitter, tag my Twitter, etc.)• You may not upload or host my work in any gallery that is intended to display your own work only.• DO NOT CLAIM MY ART AS YOUR OWN!! Even if you just buy lined art to colour in yourself or something, that's still my drawing at the end of the day. You didn't make that.• You may use the artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.• You reserve the right to print or create an otherwise physical reproduction of the Artwork as long as it is for your PERSONAL use only (ie. a cool picture for your room that you are NOT SELLING/MASS REPRODUCING.)• You may not use the Artwork for redistribution or external projects, commercial or non-commercial (i.e. t-shirts, mugs, public flyers, etc.) unless otherwise discussed.• You are NOT authorized to change, modify, edit or use my works without my permission.• You are NOT authorized to trace over my Artwork in any way, including the use of the artwork as a “base.”• Any harassment in an attempt to bargain for a commission is not tolerated. This includes inappropriately worded comments on my profile, as well as private messages. I reserve the right to place anyone on the blacklist over harassment.• Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.• By placing an order, you agree to these terms and conditions. Please read these terms carefully.

Me, the Artist

• By commissioning me, you are purchasing my service as an artist only.• I reserve the right to post your finished artwork on my own art accounts unless you state otherwise. I'll ask for your permission first anyway.• I reserve the right to decline any project or client for any reason.• I reserve the right to refund you the full amount paid if I can no longer complete your commission for any reason.

COPYRIGHT

• I reserve the right to watermark my own work. I will send you a full-resolution image (by email or via google docs), but my signature will remain on both the full-resolution and smaller versions of the artwork.

What I won't draw

• I will not draw NSFW, hateful content, real people (self-insert sonas are fine), gore, extremely detailed armour that I cannot simplify or mecha.
• PLEASE ASK ME ABOUT SHIPS. I WILL NOT DRAW CERTAIN SHIPS. (for example did you know the characters in Fire Emblem: Engage have canonical ages? It's deep in the game files and on the wiki. So even if you don't use them because they are not shown in game, I do.)
• Bear in mind that my furry artstyle is more semi-realistic. If this isn't to your taste, I ain't the furry artist for you.
• If you ask me to draw anything from above (or anything else I may be uncomfortable with), I reserve the right to decline your order. I'll tell you if this happens.

Extra Content

• You must state the extra content you want in your commission form. You can add as many characters, props and creatures as you want, but please be aware that these will cost more.•After I am done sketching, I will not add any more add-ons. If you really want me to, I reserve the right to charge an extra 25% of the initial cost (style, size and colouring) to make up for additional time spent sketching and rearranging things.• If you order a Complex+ Background, I will share its progress throughout your commission, and this will be the only aspect I am willing to alter past the sketching phase. However, if you request a minor change after the lining phase, there will be an additional 25% of the initial price to make up for additional time spent changing the sketch and lining.• I will not make major changes after the lining phase, so please make sure the background turned out how you wanted it during the sketching phase.


COMMISSIONS

ORDERING

• To place a commission, please fill out the Commission Form on the home section of this Carrd.• You will then get a reply from me discussing the details (if needed) as well as me confirming your slot.• To guarantee the total accuracy of your commission request, please make note of the required details and elements in the form.
• Also please provide visual references for OCs. No written refs.
• If your character is extremely detailed and you place an order for Style B or any of my Chibi Styles, I have the right to charge a fee to include these details. This fee will be stated before the transaction, and you hold the right to make changes to your commission request (eg. change the character, or agree to simplified design changes) before the transaction is complete (Style A is made for maximum details, so don't worry about this if you commission a Style A.)• Please make your request concisely worded with minimal abbreviations, so as to make the note clear to read. I'm not gonna understand terms from a fandom/intellectual property I am unfamiliar with.• Any emails, private messages, and comments that you send must come in English.• After everything is processed and confirmed, I will send you a Paypal invoice. You need to confirm the payment with me before I start your order. And obviously I need to receive said payment, so I will check my Paypal too.

PAYMENT

• I am not responsible for any mistakes that are made on your part over the course of the transaction.• I will only accept GBP via Paypal as payment. You are responsible for making currency conversions.• It is expected that you deposit 100% of the price upfront before I start.• After 100% of the payment is sent, I will start the sketching stage. The finished sketch will then be sent to you.• I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission AND have sent you an invoice/asked for payment.• Payments via Paypal are sent via Invoice method only unless otherwise stated. I will cover the Paypal fees as it is expected from the Artist per PayPal ToS. What you see is what you will have to pay.• I do not accept payment from shared PayPal accounts unless you are not of legal age and use a parent/guardian’s PayPal account.• If payment is not made in a timely manner (24h) after I've placed the Invoice, the commission will be cancelled.• Repeated counts of commissioning a project and failing to pay will result in blacklisting.

PAYPAL DISCLAIMER

• If you decide to cancel the commission before I have completed the sketch, I will issue a full refund. However, you must let me know first.• If you decide to cancel the commission after the sketch, but before it is complete, I will issue a 75% refund. (this would be a refund for what I haven't completed.)• If, for whatever reason, I cancel a project, I will give a full refund.

CHARGEBACK

• DO NOT issue a chargeback for any reason. Scammers sometimes do this and I don't wan't to be scammed thank you very much.• If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.• You are required to contact me when you need to cancel a commission request.• Purposefully issuing a chargeback without contacting me to cancel/refund a project WILL result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.


THE WORK PROCESS

QUEUE / SCHEDULING / WORK SPEED / DEADLINES

• It will take up to 3 days for me to respond to your order. I'll be as quick as possible, but please be aware that I use the GMT timezone.• You reserve the right to set a deadline for your commission. Tell me this before payment.• I always take at least 3 days to finish my art (less if it is a small project, up to 3 weeks if I am busy or your order is very large.)• Therefore, if the deadline is too short for the type of commission you want, I reserve the right to decline your order.• It is your responsibility to check in with me if you want to know where I am at with your commission at any given time. However, please do not bombard me with messages if I do not immediately respond- perhaps it is my bedtime when you message me during your day or something.• If there are any delays on my behalf, I will inform you.• No harassment over my work speed will be tolerated, regardless of the time that has passed.• My queue is a first serve, first come type of queue. So if someone has ordered and paid before you, you gotta wait your turn. If you have an important deadline, however, please let me know and I'll see if I can get it done in time.• When it is your turn to have your commission made, I will inform you.

QUEUE / SCHEDULING / WORK SPEED / DEADLINES

• I will send a WIP (‘work in progress’) image after 100% of the payment is completed.• These images will come in the form of .jpg or .png files as an attachment in the email or a DM.• The responsibility is on you to ensure your order contains the details you want me to follow.• I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.• I will only send a guaranteed WIP for the Sketch, but you are free to request a WIP at any given time.• Up to two major revisions can be made during the sketching phase of the commission. Only minor adjustments within reason can be made afterwards.• Each time I send a WIP to you, I will ask you to provide feedback to me.• Changes will only be made at the sketch stage. Colour corrections will be made at the colouring stage.• I will not redraw a completed commission unless payment is received for a second order.

Your Completed Commission

• There may be slight differences between the examples shown on my pricing page and the illustration you will receive.• The commissioner must respect that my artistic style cannot be altered.
• I reserve the right to reject critiques pertaining to artistic skill and stylization.
• Credit me when you post my work on other platforms please.
• You are responsible for saving any information, images, and other digital data I provide.
• If you lose your file, ask me and I will probably be able to send you another. However, I cannot guarantee against computer failure or accidental deletion or loss.
• Feedback on the final product is permitted after completion of the piece, through private messages or comments.• Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.
